General Terms and Conditions

1 Scope of application/conclusion of contract
Orders shall be executed exclusively on the basis of the following terms and conditions. Deviating regulations require written confirmation.

2 Prices
All prices quoted are exclusive of VAT.
Unless otherwise agreed in the offer, our offers are valid for 4 weeks.

3 Delivery
Deliveries within Switzerland will be charged a shipping and packaging fee of CHF 7.90 (CHF 8.55 incl. VAT) with A Mail and CHF 25.00 (CHF 27.05 incl. VAT) with Express. If the delivery is made as an express shipment at the buyer's request, the buyer shall bear the costs incurred. The start of the delivery and performance period stated by us is subject to the clarification of all technical questions. If a proof copy is produced in advance, CHF 12.50 (CHF 13.50 incl. VAT) per proof copy will be charged as an expense allowance from the second version onwards. The place of fulfilment is Widnau. Deliveries are made at the risk of the recipient.

4 Warranty
Defects in goods must be reported to us within a period of 8 days after receipt of the goods.
In the event of justified complaints about defects, the seller shall only provide a reduction in the purchase price or replacement with defect-free goods. Claims for damages due to defects are excluded unless the damage was caused by intent or gross negligence on the part of the seller. We expressly point out that we accept no liability for defects caused by incorrect order details provided by the buyer.

5 Liability
The customer's attention is expressly drawn to the fact that the system may fail for technical reasons. The seller accepts no liability for the unrestricted availability of the online shop. Likewise, the seller cannot accept any liability for incomplete data or other transmission errors. We would like to point out that due to the public nature of the Internet, the transmission of data or other information is at the risk of the customer. We accept no liability for the content of Internet sites that can be accessed via links from our homepage.

6 Terms of payment
Payments are to be made within 30 days of the invoice date without deduction. In the event of late payment, interest on arrears shall be charged at the respective base rate. Furthermore, the buyer undertakes to reimburse the costs of the reminder, the collection agency and any legal fees. The deduction of discounts requires special written agreements.

7 Cancellation
Customers are entitled to withdraw from the contract concluded via the Internet within 7 days of receipt of the goods by the customer, whereby Saturday does not count as a working day. Excluded from this right of cancellation are goods that have been specially manufactured for the customer and therefore cannot be resold to another customer.

8 Return costs
It is expressly agreed that the customer shall bear the costs of returning the goods in the event of cancellation.

9 Reservation of availability
If the ordered goods are no longer available or cannot currently be delivered, the seller is entitled to deliver goods of equivalent quality and price or to withdraw from the contract without the customer being able to derive any claims from this. Any payments already received will be refunded immediately.

10 Applicable law
Swiss law shall apply.

11 Retention of title
The goods remain the property of the seller until full payment of the invoice and any interest and costs incurred as a result of late payment.

12 Data protection
We would like to point out that customer data is stored and processed electronically for the purpose of order processing, accounting and customer service. The seller undertakes to treat this data in accordance with the guidelines of the Data Protection Act and not to pass it on to third parties.

14 Special provisions for entrepreneurs
If the buyer sells the goods that are still subject to the seller's retention of title, he shall assign to the seller the claims arising against his customer together with all ancillary rights up to the amount of the seller's claims. If samples and artwork provided by the Buyer are used, the Buyer shall indemnify and hold the Seller harmless against any third-party claims arising from such artwork, e.g. copyright claims and others.

The place of jurisdiction is Widnau.
